Federal Court Mandates Release of Abrego Garcia from ICE Detention

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.

The case stems from a erroneous removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer alien smuggling charges, he was held in immigration custody.

In her decision, the judge noted that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The legal proceedings center on disputed assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a ongoing criminal case in Tennessee.

The judge, who was hearing his petition to removal in a Maryland district court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
